1. Agreement to Terms

By accessing and using Mark ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. We reserve the right to modify this agreement at any time. Your continued use of Mark following the posting of revised Terms means that you accept and agree to the changes.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on Mark for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials
  • Use the materials for any commercial purpose or for any public display
  • Attempt to decompile or reverse engineer any software contained on Mark
  • Remove any copyright or other proprietary notations from the materials
  • Transferring the materials to another person or "mirror" the materials on any other server
  • Use automated tools (bots, scrapers, crawlers) except those authorized by Mark

3. User Accounts

If you create an account on Mark, you are responsible for maintaining the confidentiality of your account information and password and for restricting access to your computer. You accept responsibility for all activities that occur under your account. You agree that the information you provide when registering is accurate and complete.

4. Content You Create

Your Ownership

You retain ownership of all content you create using Mark, including generated strategies, content, and analyses. We claim no ownership over content you generate.

License to Mark

By uploading or creating content in Mark, you grant us a license to use, reproduce, and distribute your content for the purpose of delivering the Service, including:

  • Storing and displaying your content in your workspace
  • Processing your content through AI models to generate strategy and recommendations
  • Creating backups for data recovery
  • Analyzing usage patterns to improve our service

Data Processing

Content you submit (including website URLs, business descriptions, and competitive data) will be processed by Mark and may be sent to third-party AI services (Anthropic Claude) to generate insights. See our Privacy Policy for details.

5. Acceptable Use Policy

You agree not to use Mark for:

  • Illegal activities or violating any laws
  • Harassing, threatening, or intimidating others
  • Infringing intellectual property rights
  • Distributing malware, viruses, or harmful code
  • Spam or unsolicited commercial messages
  • Accessing others' accounts without authorization
  • Generating deceptive, false, or misleading content intended to harm individuals or businesses
  • Analyzing competitors' websites for industrial espionage or illegal purposes
  • Generating content for adult, violent, or illegal use cases
  • Overloading or attempting to disrupt the service

6. Limitation of Liability

Mark is provided "as is" without warranties of any kind, either express or implied. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Mark shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill, even if we've been advised of the possibility of such damages.

Your sole remedy for dissatisfaction with Mark is to stop using the service.

7. Warranties Disclaimer

The materials on Mark are provided on an 'as is' basis. Mark makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

8. Limitations

Mark will not be liable for any damages or loss caused by denial of service attacks, viruses, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of Mark or any services or items obtained through Mark or to downloading of any material posted on it.

9. Accuracy of Materials

The materials appearing on Mark could include technical, typographical, or photographic errors. Mark does not warrant that any of the materials on the site are accurate, complete, or current. Mark may make changes to the materials contained on the site at any time without notice.

AI-generated content is provided for reference and inspiration only. You are responsible for reviewing, editing, and validating all generated content before publishing or using it.

10. Materials and Content

Mark has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Mark of the site. Use of any such linked website is at the user's own risk.

11. Modifications

Mark may revise these terms of service for the website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.

12. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the United States, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

13. Billing and Subscription

Free Trial

If you sign up for a free trial, your trial period will last for the specified duration (if any). At the end of your trial, you will be charged according to your selected plan unless you cancel before the trial ends.

Paid Subscription

If you purchase a subscription, you agree to:

  • Pay the subscription fee disclosed at the time of purchase
  • Allow automatic recurring charges to your payment method
  • Update your payment information if your card expires or is lost

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation becomes effective at the end of your current billing cycle. No refunds are provided for partial months.

Price Changes

We reserve the right to change prices with 30 days' notice. Changes take effect on your next billing date. If you don't accept the new price, you may cancel your subscription.

14. Service Availability

We aim for 99.5% uptime but do not guarantee uninterrupted service. We may perform maintenance, updates, or suspend service due to technical issues, security concerns, or legal requirements without liability.

15. Third-Party Services

Mark integrates with third-party services including Anthropic Claude, Supabase, Stripe, and others. Your use of these services is subject to their terms and privacy policies. Mark is not responsible for their performance or policies.

16. Indemnification

You agree to indemnify and hold harmless Mark, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of Mark
  • Content you create or upload
  • Your violation of these terms
  • Your violation of any law or third-party rights

17. Termination

Mark reserves the right to terminate your account and access to the service at any time, with or without cause, and with or without notice. Reasons for termination may include:

  • Violation of these terms
  • Illegal activity
  • Non-payment
  • Misuse of the service
  • Technical or business reasons

Upon termination, you may request your data be exported or deleted per our Privacy Policy.
